The Delhi High Court has been actively working to uphold the rights of students from the Economically Weaker Section (EWS) by ensuring their admission in private schools in accordance with the Right to Education (RTE) Act.

In the 1993 case of Unni Krishna vs. State of Andhra Pradesh, the Supreme Court affirmed that Article 21A of the Constitution mandates the state to provide free and compulsory education to all children aged 6 to 14. This constitutional provision was later implemented through the Right of Children to Free and Compulsory Education Act, 2009.
